Magoffin County Judge-executive being forced out of office

In Magoffin County, a judge-executive is trying to appeal the decision made to force him out of office. Charles Hardin has filed a motion for reconsideration with the state Court of Appeals. A three judge panel made a decision last month that the judge executive’s election was corrupt last year and the position should be vacated. The motion will allow Hardin to stay in office while the Court of Appeals consider his request. Hardin was the incumbent when he defeated John Montgomery by 28 votes last November. Montgomery sued and offered evidence of vote buying and bribes. Hardin denied the charges against him. The appeals court said a special election should be held for the position.
