Close to one month ago, a Johnson County man shot his brother.

Deputies said one man is behind bars after a Johnson County shooting. It happened on the night of Tuesday, September 17 on KY Route 302 in Van Lear.

According to an arrest citation, 42-year-old Joseph Fannin was arguing with his brother over scrap metal when Fannin reached for a gun. The two men struggled, deputies said, and Fannin pulled the trigger twice. The victim was hit in the hand and the torso. Fannin’s brother was flown to Pikeville Medical Center and was stabilized. Fannin was charged with first-degree assault and taken to the Big Sandy Regional Detention Center. Deputies said he told them he took Methodone that day.

Last week, the accused shooter, Joseph Fannin, was released from the Big Sandy River Regional Detention Center. The Johnson County Court Clerk said he was released on the condition that he had “no more violations of law.” Those close to David Fannin, the victim of the shooting, say they are upset about his release.

“We’re angry. It’s not fair. David’s been in the hospital fighting for his life. It’s not fair,” said David Fannin’s Fiancé Wendy Thacker. Thacker said that David Fannin is in stable condition, but he still can not walk. She said the support of family and friends is helping them get by.

“A lot of people like him so it has been overwhelming at the support we’ve had,” said Thacker.
