Who owns KENTUCKY?

An Eastern Kentucky business has come into conflict with the University of Kentucky over a trademark. The Kentucky mist distillery in Letcher County received a letter from an attorney proclaiming to represent the University of Kentucky about an alleged infringement of an iconic symbol. UK holds that they have a trademarked right to the use of the work Kentucky in all capital letters on merchandise, and asked that the distiller change their t-shirt design to not mimic their merchandise. In the letter sent from the office of Michael Hargis the university also request that the distiller change their color scheme to look less like the university colors. Kentucky Mist Owner Colin Fultz claims that their logo looks nothing like the University’s, the one exception being a dark blue drink holder.
