The regulation in question is designed to lower the number of black lung cases, by increasing air quality samples in underground mines. The suit was filed by several coal corporations, and included the National Mining Association. Their goal was to push back the implementation date, which is set for February the first. The group argued that the U.S. Mine Safety and Health Administration overstepped their authority when they issued the new rule. Yesterday the 11th Circuit US Court in Atlanta ruled that MSHA was well within its rights.
