Governor Bevin and the Commonwealth of Kentucky has joined a 21 state coalition challenging the United State Department of Labor’s new overtime rule. If implement, the new rule will more than double the minimum salary threshold for public and private workers without congressional authorization, substantially increasing employment costs. Governor Bevin said the new rule is a violation of the Tenth Amendment of the Constitution and that it is “another example of the federal government’s never-ending attempt to encroach upon the rights of individual states.” According to the new rule, after December 1, 2016, all employees are entitled to overtime if they earn less than $913 a week – including state and local government employees.
