Kentucky Lawmakers return to Frankfort today as the General Assembly resumes, and one of the bills before them is designed to cut down on frivolous lawsuits in the Commonwealth. In four of the last five sessions, the state senate has approved a medical review panel bill only to see it die in the house. With a change in control of the house, supporters are hopeful for passage this year. Each party to a malpractice suit picks an expert and the sides agree on a third one. That panel reviews the merits of the case. The lawsuit can proceed either way but the findings can be used in court. The Kentucky Chamber of Commerce supports the bill, terming it “the common sense reform” that will lead to better medical care and less “defensive” medicine.
