
Attorney General Daniel Cameron has filed a motion to defend the placement of Marsy’s Law on the November ballot after the Association of Criminal Defense Lawyers filed a lawsuit to challenge the constitutionality of Marsy’s Law, which was passed overwhelmingly by Kentucky lawmakers.
Marsy’s Law seeks to give crime victims meaningful and enforceable constitutional rights equal to the rights of the accused. Some examples of the types of rights to which we believe all victims are entitled are:
- To be treated with dignity and respect throughout criminal justice proceedings
- To be notified of his, her or their rights as a victim of crime
- To be notified of specific public proceedings throughout the criminal justice process and to be present and heard during those proceedings\
Back in 2018, voters approved the measure but it was struck down by the Kentucky Supreme Court because of the way the question was worded.
Cameron says he will defend the right for Kentuckians to vote on the proposed constitutional amendment.
