A magistrate out of Martin County was arrested for DUI while driving a side-by-side this past Wednesday night.

A state trooper arrested 60-year-old Roger Preece, of Debord, after pulling him over on Davella Road, just before 9 PM.

The trooper made note that Preece failed to stop at first when he attempted to pull him over. He also noted that Preece had difficulty standing and refused to follow orders to get out of his vehicle.

A breathalyzer test revealed that Preece had a blood-alcohol level of 0.173, which is more than twice the legal limit.

Preece was charged with DUI, fleeing police, and resisting arrest among other charges.
