
One of the men being charged in a burglary case in which the homeowner died, is now receiving a charge for murder.
39-year-old Curtis Jones, of Rockhouse, was charged by a Pike County grand jury with killing 60-year-old Timothy Justice, of Elkhorn City, during the break-in on December 18th. Jones faces additional charges for felon in possession of a firearm and tampering with physical evidence.
Additionally, he has been charged alongside 47-year-old James Dewayne Phillips, of Elkhorn City, with first-degree burglary in relation to the burglary.
If convicted of the burglary charge, Phillips will face up to a 20-year prison sentence.
Jones could face anywhere between 20-years to life-in-prison if convicted. The burglary charge may also potentially enhance the burglary charge to make Jones eligible for the death penalty. Prosecutors have currently given no indication to whether or not they will seek this outcome.
