Floyd County Attorney Eric C. Conn invokes the fifth amendment yesterday in court, refusing to testify in a hearing concerning the lawsuits against him by former clients. Conn is suspected of using fraudulent information to insure disability benefits for former clients from both Kentucky and West Virginia. The hearing was a continuation from events that began on Friday, concerning a temporary restraining order that will keep Conn or any of his staff from destroying medical documents and records. Former staff members have testified that they were instructed to destroy the records and a computer. Conn’s lawyers asked for Circuit Judge Johnny Ray Harris to throw the restraining order out and to dismiss the case, but Harris said a ruling would be made today.
