The Commonwealth of Kentucky Court of Appeals ruled on Thursday, November 9, 2017 in favor of the Bevin Administration by granting a stay of the Franklin Circuit Court’s October 30, 2017 ruling the Medical Review Panels case. Senate Bill 4, enacted by the 2017 General Assembly and signed into law by Governor Matt Bevin, requires peer review of medical malpractice complaints by Medical Review Panels before medical malpractice cases can go to court. The Circuit Court ruled the Medical Review Panel law as unconstitutional. Following the ruling, 89 current cases will proceed, with prospective cases requiring review. The Court of Appeals stay will remain in effect until further ruling.
